TERMS & CONDITIONS OF PURCHASE
Gaki.gr ("Gaki" "we" "us") website (our "Site") and related services are made available to you in accordance with the following General Terms and Conditions for Purchase, and any other rules posted on our Site (collectively, ‘’Terms and Conditions’’). Please read carefully before placing any orders on www.gaki.gr. We recommend you should keep a copy of the Terms and Conditions for future reference.

In particular, we wish to draw your attention to our policies relating to the terms of purchase within the Terms and Conditions and our Privacy Policy. The range of goods in the Online Store is aimed only at consumers whose habitual place of residence is in Greece or in countries of the European Union, and who can provide a delivery address there and who are of legal age. If you are under 16 you must let your parent or guardian know about Gaki's Privacy Policy before you register to use this Site or any of this Site's services. We reserve the right to only accept orders from those over 18 however. Consumer within the meaning of the statutory definition is any natural person acting for purposes which are wholly or mainly outside his trade, craft or business.
We may modify the Terms and Conditions from time to time. Please read the Terms and Conditions and check back often. If you do not agree to any change to the Terms and Conditions then you must immediately stop using the Site. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.
ELIGIBILITY TO PURCHASE
In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide personal information that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.
The Site is available only to individuals and others who meet the Gaki's terms of eligibility. Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. In addition, Gaki reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
THE ORDER PROCESS
All orders are subject to acceptance and availability, and items in your shopping bag are not reserved and may be purchased by other customers. The goods remain the property of Gaki until the Customer has paid the purchase price in full.
The Online Store merely constitutes an invitation to the Customer to make an offer to enter into a purchase contract for the goods presented in the Online Store. You may select items from our range of goods and collect these in a "Shopping Bag" by clicking on the "Add to Shopping Bag" button. By clicking on the button “PROCEED AND CHECK OUT, you make an offer to purchase the goods that are in the Shopping Bag (the "Order“).
Before placing an Order, you can view and amend the details of your Order at any time by clicking on the "Shopping Bag" button.
After submitting your Order, you will automatically be sent an acknowledgment of receipt by e-mail with a summary of the details of your Order. This automatic acknowledgment of receipt does not constitute acceptance of your offer by Gaki; it merely documents the fact that Gaki.gr has received your Order.
A binding contract of sale is concluded when Gaki accepts your order. Gaki is entitled but not obliged to accept your offer within 7 days from its receipt. Gaki declares its acceptance by sending you a dispatch confirmation by e-mail (also referred to as the "Contract Confirmation"’’ Dispatch Confirmation’’). If several items are included in an Order, a contract is only concluded in respect of the items expressly mentioned in the Contract Confirmation.
The foregoing also applies where, due to your selected method of payment, you have already paid the purchase price or given payment instructions before the conclusion of the contract. If for any reason no contract is concluded, Gaki will notify you of this by e-mail, and refund you the pre-payment without delay.
Your statutory right of withdrawal remains unaffected by the preceding provision.
Gaki will store a record of your transactions for a minimum of one year.
ACCEPTANCE OF YOUR ORDER
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.
Unless you cancel your order, acceptance of your order and completion of the contract between you and Gaki will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Greece and the language of the contract is English. Neither our third party payment processor nor our nominated courier has the authority to accept an order on behalf of Gaki.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms and Conditions.
We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
Every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfill an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.
DELIVERY, DELIVERY TIMES, DELIVERY CHARGES, AVAILABILITY, PRODUCT PRESENTATION
Gaki insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by Gaki, and transfer of responsibility in the same way. In the event that the customer or specified recipient does not sign for goods delivered (signature waiver) any loss and/or damage (for whatever reason) from the time of dispatch onward is the sole responsibility of the customer. Gaki will not be held liable under any circumstance.
Please note that we aim to dispatch all orders within 24 hours, or 48 hours during sale periods. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Gaki is not responsible for any delays caused by destination customs clearance processes.
Delivery is only available within the European Union and orders will be dispatched only after the full purchase price has been credited to our account.
After the goods have been handed over to the carrier, you will receive an e-mail with a confirmation of dispatch from the Seller and a tracking link allowing you to monitor the delivery status of your Order.
If we are unable for reasons beyond our control to meet a binding delivery deadline, we will inform you without delay and, where applicable, specify a new estimated date of delivery. If the new delivery time is unacceptable to you or the goods are also not available within the new delivery time or not available at all, we will give you a refund for any payment already made. Any statutory rights of the parties will remain unaffected.
The goods offered on Gaki are presented on the Website in the form of digital photographs of the actual products. Minor discrepancies between the presentation and the actual products do not qualify as a defect in the goods ordered.
PRICES AND CHARGES
Prices shown on the Site are in Euros and are inclusive of VAT at the applicable rate. All prices and offers remain valid as advertised from time to time. The euro price of a product displayed on the Site at the time the order is accepted will be honored, except in cases of error. These prices are subject to change as the items are subject to markdowns at any time during the selling period.
We will notify you, where applicable, of the delivery charges as well as of any additional charges, e.g. for gift wrapping, on the order form immediately before the Order is placed. The Customer will bear the notified delivery charges and any additional charges.
PAYMENT
Gaki does not store payment information such as credit card numbers or bank account numbers. We accept Visa, Visa Electron, MasterCard, American Express, Maestro and Diners via the Alpha Bank e-Commerce Service. The Alpha e-Commersce Service uses the world’s best practice for e-commerce payments and is fully compatible with the international security protocols Verified by Visa and Mastercard SecureCode for secure on-line card payments.
You can also choose to pay with PayPal. When selecting this option at checkout, you will be directed to the PayPal site to 'Log In' and review the amount shown before clicking 'Pay Now'. Once this transaction is complete, you will then return to the Gaki Online Store to complete your purchase.
Please note, payment is only debited from your card at time of acceptance and dispatch.
RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within 14 days without giving any reason, from the day that you acquire, or a third party named by you who is not the carrier, acquires physical possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g a letter send by post or e-mail). You can also exercise your right of withdrawal by returning the relevant item to us, together with the pre-printed returns label that was included with the delivery, no separate declaration is then necessary.

EFFECTS OF THE RIGHT OF WITHDRAWAL
If you withdrawal from this contract, we shall reimburse you to all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of type of delivery other than the economical standard delivery offered by us), without undue delay and in any event not later than 14 days from the earlier of the day on which we receive the returned goods from you or evidence that you have send them back. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise with you; in any event, we will not impose any fee for such reimbursement.
We may withhold reimbursement until we have received the returned goods or until you have supplied evidence of having send back the goods, whichever is the earliest.
You shall send back the goods without delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
RETURN POLICY
Should you not be happy with your purchase, you have 14 days from when you receive your package to make a return. Items must be in original condition with all original Gaki tags attached. The obligation for return does not apply when any of the tags have been removed or damaged. The same applies when the returned item(s) are determined to have been used, worn, washed or damaged. Items should be returned unused and with all garment tags still attached. Returns that are damaged or soiled may not be accepted and may be sent back to the customer and/or a refund refused.
FAULTY GOODS
Goods are faulty if they are received damaged or where a manufacturing fault occurs. Items that are damaged as a result of normal wear and tear are not considered to be faulty.
If you would like to exchange a faulty item instead of obtaining a refund, please be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, we will offer to repair faulty items. If it cannot be repaired or the same product is not available, you are entitled to a full refund.
COLORS
We have made every effort to display as accurately as possible the colors of our products that appear on Gaki. However, as computer monitors vary, we cannot guarantee that your monitor's display of any color will be completely accurate.
REPEATED RETURNS
We offer a flexible returns policy to make your online shopping experience even easier. However, we do monitor the number of returns made and may refuse to accept orders at our discretion if goods are returned repeatedly.
LIABILITY
Gaki strives to ensure that the Site is administered and maintained with due care. Nonetheless, we do not warrant that the information contained on Gaki is error-free or accurate or that access to Gaki will be uninterrupted. Furthermore, it disclaims any liability for lost, damaged or deleted downloads. We accept no liability for any damage arising directly or indirectly from the use of Gaki.
We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity).
We are also not responsible for failure to meet any of our obligations under the Terms and Conditions where such failure is due to events beyond our reasonable control.
CHOICE OF LAW AND JURISDICTION
Contracts between the Seller ‘’Gaki’’ and the Customer ‘’you’’ as well as these General Terms and Conditions are governed by the laws of the part of Greece.
